1. Personal data processed:

Depending on how you use our Services, we may process the following categories of personal data:

3. Purpose Treatment:

The various purposes for which Raccorder processes your personal data are set out below:

  • Management of free or paid contracting of services offered from the «Raccorder App» application.
  • Management of queries, complaints/incidents, claims and requests made by the user/customer.
  • Management of the sending of commercial communications.
  • Management of analytical work and market research, through cookies, and other similar technologies and tools.
  • Management of the tracking of customers using the Web/App, to identify ways to improve the browsing experience.

4. Retention of your data:

Your personal data will be kept as long as the contractual relationship is maintained, and, in any case, for the time necessary to fulfill the purpose for which they were collected, as well as to meet the possible responsibilities that may arise from the purpose, in addition to the periods established in the applicable regulations in each case.

Once the relationship is terminated, your data will be kept blocked for a maximum period of 5 years to meet possible requirements made by you, the tax authorities, data protection, as well as the Administration of Justice or the Forces and Security Forces of the State. After that period, all your personal data and all information uploaded to the App will be deleted.

5. Legitimacy of the treatment

  • Management of pre-contractual and, where appropriate, contractual measures, based on Article 6.1.b) of the GDPR.
    • Regarding customers who use the service provided in the App either in its free or paid version by accepting the Terms and Conditions included in the App.
    • By browsing the Website/App and agreeing to the Terms of Use of the Website/App.
  • Compliance with legal obligations, based on Article 6.1.c) of the GDPR.
    • In cases in which the interested party exercises the rights indicated below.
    • As a consequence of the legal actions promoted by or directed against Raccorder before the organs of the Administration of Justice.
  • The unambiguous consent of the data subject, based on Article 6.1.a) of the GDPR.
    • In case of contacting Raccorder through its contact form in order to manage the queries raised and contact the person concerned.
    • Obtained through the acceptance of cookies and other analytics tools.
    • When you consent to receive commercial communications.

6. Recipients of your personal data.

No transfer of your data to third parties is foreseen, unless legally required or requested by public bodies and/or authorities. 

However, in order to adequately provide the service Raccorder will rely on the collaboration of third party service providers (processors and/or sub-processors) who may have access to your personal data and who will process the referred data in the name and on behalf of Raccorder, as a consequence of their provision of services.

In the event that any of these service providers are outside the European Economic Area and international data transfers are made, Raccorder will rely on adequacy decisions adopted by the European Commission or by providing appropriate safeguards such as the European Commission’s standard contractual clauses (https://eur-lex.europa.eu/legal-content/ES/TXT/PDF/?uri=CELEX:32021D0914).

7. Rights you may exercise with respect to the processing of your personal data.

    • Right of Access: Consisting of the right to obtain information about the data concerning the data subject and which are subject to processing.
    • Right of Rectification: Consists of the right to respect the accuracy of the data, to correct or update them.
    • Right of Deletion («to be forgotten»): The right to request the deletion of data and not to have it processed, if the requirements are met.
    • Right of Opposition: The right to oppose the processing of data.
    • Right of Limitation of Processing: Right to limit access to processed data.
    • Right of Portability: The right to have the data provided to the data subject or to a third party for processing.
    • Rights to be free from automated individualized decisions: This right is intended to ensure that you are not subject to a decision based solely on the processing of your data, including profiling, that produces legal effects on you or significantly affects you similarly.
    • Right to revoke consent: Right to withdraw previously granted consent.

8. Privacy Policy Update.

Raccorder may modify this privacy policy as a result of legislative changes, jurisprudential doctrine and rulings of the AEPD that are directly, indirectly or sectorially applicable.
